Maneuvering Family Law is a Process...

Going through a divorce or custody dispute can be overwhelming.  We often remind clients that it is a process, not an "event."  Getting familiar with the terms is a good way to start and can assist you in navigating this, often times, stressful event.

Divorce vs. Legal Separation

Two options...

Parties wishing to dissolve their marriage may do so by obtaining a dissolution of marriage (divorce) or a legal separation.  The process is exactly the same for both options.  The process is also the same if you are "common law" married.  

Allocation of Parental Responsibilities

Children related issues...

Colorado uses the term "allocation of parental responsibilities" to define custody. It encompasses parenting time and decision-making.  Parties who are married or unmarried may get parental responsibilities allocated. A paternity matter can also be started. 

 

Financial Support

Spousal and child support...

Spousal support (maintenance) can be awarded if the asking party meets certain criteria.  Child support is established when the parties have a child or children.  There are guidelines that are used to help determine maintenance and child support.

Dividing Assets & Debts

What you own and Owe...

In a divorce or legal separation, the marital assets and debts must be divided equitably or fairly. There are many ways to determine values, sometimes involving expert opinion. Gift and inheritance issues can come into play here.
